You have the job. You have the skills. Now, you want the Permanent Residency.
For many skilled workers in Sydney—from Software Engineers in Barangaroo to Head Chefs in Surry Hills—the Subclass 186 Employer Nomination Scheme (ENS) is the ultimate goal. It is the "golden ticket" that allows you to live in Australia permanently, buy a home without massive foreign surcharges, and give your family certainty.
But in late 2025, the rules for the 186 visa have tightened. The transition from the old 482 visa to the new Skills in Demand visa has created confusion.
As the Best Nepali Migration Agent in Sydney, located at 301 Castlereagh Street, Right and Associates successfully lodges hundreds of 186 applications every year. Here is the blueprint we use to get our clients approved.
The Two Pathways: Which One Are You?
Most people think they have to wait 2 or 3 years to get PR. This is not always true.
1. The Direct Entry (DE) Stream
- Who is it for? People who have 3 years of full-time post-qualification experience anywhere (even outside Australia) and a positive Skills Assessment.
- The Advantage: You do NOT need to wait until you have worked for your current boss for 2 years. You can apply immediately if an employer is willing to nominate you.
- The Catch: You must have a valid Skills Assessment.
2. The Temporary Residence Transition (TRT) Stream
- Who is it for? People currently on a 482 or Skills in Demand visa.
- The 2025 Rule: You generally need to have worked for your sponsoring employer for 2 years (reduced from the old 3-year rule).
- The Advantage: usually NO Skills Assessment is required.
- The Warning: As of late 2025, the Department is strictly checking that your work experience was with an Approved Sponsor. If you worked during a "grace period" or for a company whose sponsorship lapsed, that time might not count.
Common 186 Visa "Killers" (And How We Fix Them)
Even with a willing employer, 186 visas are frequently refused. Here is why:
- The "Genuine Position" Test: The Department often argues: "Does this café really need a full-time Accountant?" or "Does this small IT firm really need a Project Manager?"
- Our Solution: We draft a massive submission (often 10+ pages) proving the business necessity, financial viability, and organizational chart of your employer. We protect your boss so they can protect you.
- The "Training Levy" (SAF): Your employer must pay the Skilling Australians Fund (SAF) levy upfront. We calculate this precisely so there are no delays.
- The Age Limit: You must generally be under 45.
- Turning 45 soon? Do not wait. Contact us immediately. We have strategies to expedite "Decision Ready" applications before your birthday.
