Partner visa refers to subclasses of visa that can be applied by spouse/de facto of Australian permanent resident or citizen or eligible New Zealand citizen. With this visa, the dependent can visit and stay in Australia permanently with their respective partner/spouse. The application of this visa differs depending on whether the applicant is onshore (in Australia) or offshore (outside Australia).
Applying Onshore (in Australia)
If you are married or in a de facto relationship with an Australian citizen or permanent resident and you are currently in Australia, you are eligible to apply for Partner visa (Temporary)(Subclass 820) & Partner visa (Permanent)(Subclass 801) visa. When you make an application for the partner visa, you will make application for both temporary (subclass 820) and permanent (Subclass 801) partner visa. First the department will approve your temporary visa if you meet all the criteria. After the two years of date of first visa application, you will be able to apply for the second stage (permanent) partner visa.
To be eligible for partner visa, you must meet following requirement:
- Married or on a de facto relationship with an Australian citizen, a permanent residents or eligible New Zealand Citizens
- Must be in genuine and continuing relationships (meet four pillars of relationship – Financial, nature of households, nature of commitment and Social aspects of relationship)
- Pass character and health tests
- Continue to be sponsored by the partner
If you meet all these criteria, your first stage partner visa (subclass 820) could be approved. Once this visa is approved, you can apply for the second stage (Subclass 801) permanent partner visa. For this, you must give the evidence to the department that you continue to be in genuine and continuing relationship with your partner. Your partner must continue to sponsor you until your permanent visa is approved.
Applying from Offshore (Outside Australia)
If you are married or in a de facto relationship with an Australian citizen or permanent resident and you are currently outside Australia, you are eligible to apply for Partner (Provisional) Visa (309) and Partner (Migrant) Visa (100) . When you make an application for the partner visa, you will make application for both temporary (subclass 309) and permanent (Subclass 100) partner visa. First the department will approve your temporary visa if you meet all the criteria. Once your subclass 309 visa is approved, you will be able to travel to Australia to remain with your partner. After the two years of date of first visa application, you will be able to apply for the second stage (permanent) partner visa.
